Terms of user agreement

The following Terms of Service including Tantransha General Terms and Privacy Statement as published on our website ("Terms") govern your access to and use of the VR Lively application and website (the "Service"), and any video, sound, text, graphics, or other materials sent, received, stored or otherwise appearing in the Service (collectively referred to as "Content").

1. Basic description of the Service

VR Lively( owned by Tantransha LLP) is a web/android app/app-based VR communication service that allows you to have video conversations with others using app and browsers. Video and sound communicated in VR Lively is only seen by the people who have access to the common live stream at the time the content is communicated. You should be aware that by if a stream is open, so anyone who knows the URL /stream name can enter the stream simply by typing the URL in the browser. If anyone enters a stream you are present in, you can see that a connection has been established. It is a user’s responsibility to make sure that they provide URL or stream name to only intended viewers. Chat messages communicated in a stream can be seen by people who are owners or members of a stream. Others can only see chat messages if they are present in the stream when the chat message is sent. Chat messages will be deleted once they have been read by the owner and all members. Stream owners can see chat messages until they have been read by all members.

2. Privacy

You understand that through your use of the Service you consent to the following collection and use of this information. Voice and video communicated in a stream are not stored anywhere in our system. Chat messages might be stored in our system to be able to provide a chat message history for a stream. You are required to register for using the service. During registration, we store your photo (not required), display name, and at least one of the following: phone number or email address. Your contact information will not be visible to other users. We may use your contact information to contact you about issues with your stream or to inform about the Service. The Content stored in the Service will be stored securely with one or more of our subcontractors, and may also be temporarily stored in other locations to facilitate the transmission of the Content to and from your devices. We will ensure that any use of subcontractors located abroad is done in compliance with applicable law.

3. Charging for Use of the Services

The Service is offered both as a free version and a paid version. You can choose to upgrade to the premium plan. If your payment is not successful, your account will be downgraded to the free plan( free upto 10 minutes) with access to premium features removed. Upgrading to premium will start a recurring subscription, and you will be billed every month in advance, on the date the subscription was first created. You can cancel the subscription at any time in "Settings" in the stream, and you will then have access to premium features for the remainder of the month you have paid for. When that month ends, your stream will automatically be downgraded to the free plan. Should you choose to re-activate your subscription during this period after cancellation, you will start a new subscription from the end date of the previous subscription and will continue to have premium features. Payment processing services for VRLively, including the processing and storing of credit card data, are provided by PayPal and are subject to the Paypal service agreements.By agreeing to these terms or continuing to operate as aVRLively premium customer, you agree to be bound by the Paypal Services Agreement, as the same may be modified by Paypal from time to time. As a condition of Paypal enabling payment processing services through Paypal, you agree to provide VRLively accurate and complete information about you and your business, and you authorize VRLively to share it and transaction information related to your use of the payment processing services provided by Paypal.

4. Security

Communication between participants is primarily sent through peer-to-peer connections, where audio and video streams are sent directly between participants and do not pass through any or our servers. Video and audio transmitted in the Service are then sent directly to the participants in a stream and is encrypted (DTLS-SRTP) with client-generated encryption keys. In cases where a user is behind a strict firewall or NAT, video and audio need to be relayed via a TURN server, but end-to-end encryption is still maintained.

5. Use of Services

You are responsible for your use of the Service, including the lawfulness of the Content. All Content is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Service and we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Service or obtained by you through the Service is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Service. You understand that by using the Service, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, Content that has been mislabeled or is otherwise deceptive. Under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content generated or made available via the Service.

6. Rights to Content

You retain your rights to any Content you submit, post or display on or through the Service. By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to process such Content in any way necessary to perform the Service. We may modify or adapt your Content in order to transmit, display or distribute it over computer networks and in various media and/or make changes to your Content as are necessary to conform and adapt that Content to any requirements or limitations of any networks, devices, services or media. We respect your right to privacy and will not access the contents of the Content. This license is only about you authorizing us to broker your Content. We give you a personal, limited, worldwide, royalty-free, non-assignable, non-sublicensable and non-exclusive license to use the software that is provided to you by us as part of the Service for your personal use. This license is for the sole purpose of enabling you to use the Service as provided by us, subject to these Terms.

7. Restrictions on Content and Use of the Service

We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any Content on the Service and to terminate stream ownership. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to (i) satisfy any applicable law, regulation, legal process or governmental request, (ii) enforce the Terms, including investigation of potential violations hereof, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) respond to user support requests, or (v) protect our rights, property or safety, our users, and the public. You may not do any of the followings while accessing or using the Services: (i) access, tamper with, or use non-public areas of the Service, our internal computer systems including technical delivery systems of our subcontractors used to provide the Service; (ii) probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures; (iii) access or search or attempt to access or search the Service by any means (automated or otherwise) other than through our currently available, published interfaces that are provided by us (and only pursuant to those terms and conditions), unless you have been specifically allowed to do so in a separate agreement with us; (iv) forge any TCP/IP packet header or any part of the header information in any email or posting, or in any way use the Service to send altered, deceptive or false source-identifying information; or (v) interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Service or its users. The Service is for legitimate individual use only (personal or business communication). We may on our option, terminate our relationship with you, or suspend your access to the Service immediately if it is deemed by us that you are using your subscription contrary to these Terms. We will attempt to provide you with notice of improper usage before suspension or termination of your subscription and may, if appropriate, offer you an alternative service. We reserve the right to report illegal activity to applicable authorities.

8. Entire Agreement

These Terms, including Tantransha LLP General Terms and Privacy Policy, are the entire and exclusive agreement between us and you regarding the Services (excluding any services for which you have a separate agreement with us). In the case of conflict between the documents, these Terms will take precedence over the more general terms stated in Tantransha LLP General End User Agreement and Privacy Statement. We retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.
